A work injury should not be your expense. Workers' compensation is a no-fault law. Therefore, it is your employer’s obligation to pay for medical treatment and lost wages while you recover. An Employee May Be Entitled to the Following Workmans Comp Benefits:

Medical Expenses: If you are injured at work, every medical expense is covered by your employer’s workers’ compensation insurance. Whatever medical treatment is necessary to relieve you of all symptoms of injury must be paid for by your employer. This includes prescriptions, physical therapy, and, sometimes, mileage for doctors' visits. While your employer can choose your doctor, I can request an order from the court to change the doctor if you feel pressured to return to work before recovery.

Temporary Total Disability Benefits: When you are recovering and unable to work, temporary total disability (lost wages) reimburses you two-thirds of your average weekly wage, not to exceed the state maximum.

Permanent Disability Benefits: If you are permanently injured, you are entitled to compensation. There are different types of disability pay depending on whether there is permanent total disability, or partial disability.

Survivors’ or Death Benefits: If an employee is killed at work, his or her family is entitled to workers’ compensation benefits.

While vocational rehabilitative benefits are not part of the standard workers’ compensation package, I try to negotiate settlements for my clients that provide enough to retrain and start a new career if they cannot continue in their current positions.
